Herman Case

Companies† list in both 2008 and 2010. The three high-technology organizations selected for these lists were Microsoft, Cisco, and Google. Unlike most firms, especially those in mature industries and most of its office furniture rivals, Herman Miller had pursued a path distinctively marked by reinvention and renewal. This path had served it well over the decades. It survived the Great Depression early in its history and multiple recessions in the 20th century In the early part of the 21st century, it recovered from the dot. Com bust.In 201 2, Herman Miller once again was facing turbulent and uncertain economic conditions. Would its propensity for using innovation to reinvent and renew its business once again allow the company to flourish and grow? How far and how fast might the company be able to push its annual revenues above the 201 1 level of $1. 6 billion? COMPANY BACKGROUND Herman Miller's roots went back to 1905 and the Star Furniture Company, a manufacturer of traditiona listic bedroom suites in Zealand, Michigan. In 1909, it was renamed Michigan Star Furniture Company and hired Dirk Jan De Pre as a clerk.De Pre, became president in 191 9 and four years later convinced his father-in-law, Herman Miller, to purchase the majority of hares; De Pre renamed the company Herman Miller Furniture Company in recognition of Millers support. In 1 927, De Pre committed himself to treating â€Å"all workers as individuals with special talents and potential. † This occurred after he visited the family of a millwright who had died unexpectedly. During the visit, the widow read some poetry Upon asking the widow who the poet was, De Pre was surprised to learn it was the millwright.This led him to wonder whether the millwright was a worker who wrote poetry or a poet who worked as a millwright. This story was part of Herman Miller's corporate culture, which intended to generate respect for all employees and fueled the quest to tap the diversity of gifts and skill s held by all. In 1 930, the United States was in the Great Depression and Herman Miller was in financial trouble. As De Pre was looking for a way to save the company, Gilbert Rhode, a designer from New York, approached him and told him about his design philosophy.Rhode then asked for an opportunity to design a bedroom suite for a fee of $1 ,OHO. When De Pre reacted negatively to such a fee, Rhode suggested an alternative payment plan-?a 3 percent royalty on the furniture sold-?to which De Pre agreed, figuring that there as nothing to lose. A few weeks later, De Pre received the-first designs from Rhode. Again, he reacted negatively. In response, Rhode wrote De Pre a letter explaining his design philosophy: â€Å"[Horst,] utter simplicity: no surface enrichment, no carvings, no molding, [and second,] furniture should be anonymous.People are Important, not furniture. Furniture should be useful† Rhodes designs were antithetical to traditional designs, but De Pre saw merit in th em and set Herman Miller on a course of designing and selling furniture that reflected a way of life. In 1 942, Herman Miller produced its first office furniture-?a Gilbert Rhode sign referred to as the Executive Office Group. Rhode died two years later, and De Pre began a search for a new design leader. After reading an article in Life magazine â€Å"about designer George Nelson, De Pre hired Nelson as Herman Miller's first design director.In 1 946, De Pre hired Charles and Ray Names, a husband-and-wife design team based in Los Angels. In the same year, Charles Earn sees designs were featured in the first one-man furniture exhibit at New Work's Museum of Modern Art. Some of his designs became part of the museum's permanent collection. Many sources were helpful in providing material for this case, m ¶SST articulacy employees at Herman Miller who generously shared their time and viewpoints about the company to help ensure that the case accurately reflected the company's practices and culture.They provided many resources, including internal documents and stories of their personal experiences. In 1 950, Herman Miller, under the guidance of Dry. Carl Frost, a professor at Michigan State University, became the first company in the state of Michigan to implement a Scansion Plan, a productivity incentive program devised by labor expert Joseph N. Scansion. Underlying the Scansion Plan were the principles of equity and justice for everyone in the company† Two major functional elements Of Scansion plans were the use of committees for sharing ideas on improvements and a structure for sharing increased profitability.The relationship between Frost and Herman Miller continued for at least four decades. During the asses, Herman Miller introduced a number of new furniture designs, including those by Alexander Gerard, Charles and Ray Names, and George Nelson. Specifically, the company introduced the first molded fiberglass chairs and the Names lounge chair and ottoman (see Exhibit 1). The Names designs were introduced on NBC Home Show with Arlene Francis, a precursor to the Today show. Also in the asses, Herman Miller began its first overseas foray, selling its products in the European market. In 1 962, D. J.De Pre became chairman of the board and his son, Hugh De Pre, became president and chief executive officer. D. J. De Pre had served for more than 40 years as the president of Herman Miller. EXHIBIT 1 Names Lounge Chair and Ottoman During the 1 sass, Herman Miller introduced many new designs for both home and office. The most notable design was the Action Office System, the rolls first open-plan modular office arrangement of movable; panels and attachments. By the end of the 1 sass, Herman Miller had formed a subsidiary in England with sales and marketing responsibility throughout England and the Scandinavian countries.The company also established dealers in South and Central America, Australia, Canada, Europe, Africa, the Near East, and Japa n. In 1 970, Herman Miller went public and made its first stock offering. The stock certificate was designed by the Names office staff. The company entered the health/science market in 1 971 and introduced the Oregon chair, its first design eased on scientific observation and ergonomic principles, in 1976. In 1 979, in conjunction with the University of Michigan, Herman Miller established the Facility Management Institute, which pioneered the profession of facility management.The company continued to expand overseas and introduce new designs throughout the asses. By 1 977, more than half of Herman Miller's 2,500 employees worked outside the production area. The Scansion Plan therefore needed to be overhauled, since it had been designed originally for a production workforce. In addition, employees worked at multiple U. S. And overseas locations. In 1 978, an ad hoc committee of 54 people from nearly every segment of the company was elected to examine the need for changes and to make recommendations.By January 1979, the committee had developed a final draft. The plan established a new organization structure based on work teams, caucuses, and councils. All employees were given an opportunity to discuss the new plan in small group settings. On January 26,1 979,96 percent of the employees voted to accept the new plan. After 18 years as president and CEO, Hugh De Pre stepped down; his younger brother, Max De pre, became chairman and chief executive officer n 1980. In 1981, Herman Miller took a major initiative to become more efficient and environmentally friendly.Its Energy Center generated both electrical and steam power to run its 1 -million-square-foot facility by burning waste. 2 In 1983, Herman Miller established a plan whereby all employees became shareholders. This initiative occurred approximately 10 years before congressional incentives fueled employee stock ownership plan (ESP.) growth. In 1 984, Herman Miller introduced the Aqua chair, a second chair base d on ergonomic principles; many other designs followed in the 1 9805. In 1987, the iris non-De Pre family member, Dickered, became chief executive officer.By the end of the decade, Time magazine had recognized the Aqua chair as a Design of the Decade. Also, in 1989, Herman Miller established its Environmental Quality Action Team, whose purpose was to â€Å"coordinate environmental programs worldwide and involve as many employees as possible. † In 1990, Herman Miller became a founding member of the Tropical Forest Foundation and was the only furniture manufacturer to belong. That same year, it discontinued using endangered rosewood in its redrawing Names lounge chair and ottoman, and substituted cherry and walnut from sustainable sources.It also became a founding member of the U. S. Green Building Council in 1994. Some of the buildings at Herman Miller were used to establish Leadership in Energy and Environmental Design (LED) standards. Because of its environmental efforts, He rman Miller received awards from Fortune magazine and the National Wildlife Federation in the 1 9905. Also in the 1 sass, Herman Miller again introduced some groundbreaking designs. In 1 994, it introduced the Aaron chair (see Exhibit 2), which almost immediately was added to the New York Museum of Modern Art's permanent sign collection.In 1999, the Aaron chair won the Design of the Decade Award from Businesslike and the Industrial Designers I Society of America. In 1 992, J. Kermit Campbell became Herman Miller's fifth CEO and president. He was the first person from outside the company to hold either position. In 1995, Campbell resigned and Mike Evolved was promoted to CEO. Evolved, just 39 years old, had been with a company called Meridian for seven years before Herman Miller acquired it in 1990, so when he became CEO he had been with either Herman Miller or its subsidiary for 12 years.At the time, the industry was in a slump and Herman Miller was being restructured. Sales were ap proximately $1 billion annually. EXHIBIT 2 The Herman Miller Aaron Chair In 1 994, the company launched a product line called Herman Miller for the Home to focus on the residential market. It reintroduced some Of its modern classic designs from the asses, asses, and asses as well as new designs. In 1998, it set up a specific website (www. Home. Com) to tap into this market. Attachments took additional marketing initiatives to focus on small and midsized businesses.It established a network of 1 80 retailers to focus on small genuineness and made a 3-D design computer program available to midsized customers. In addition, its order entries were digitally linked among the company and its suppliers, distributors, and customers to expedite orders and improve their accuracy 3 THE FIRST DECADE OF THE 21ST CENTURY The first decade of the 21 SST century started off spectacularly for Herman Miller, with record profits and sales in 2000 and 2001.The company offered: an employee stock option pla n (ESP.) in July 2000, and Time magazine selected the Names molded ply'. Judd chair a Design of the Century. Sales had ore than doubled in the six years that Mike Evolved had been CEO. Then the dot. Com bubble burst and the terrorist attacks of September 1 1 , 2001, shook the U. S. Economy. Herman Miller's sales dropped by 34 percent, from more than $22 billion in 2001 to less than $1. 5 billion in 2002. In the same two years, the company saw a decline in profits from a positive $144 million to a negative $56 million.In an interview for Fascinating magazine in 2007, Evolved said, â€Å"One night went to bed a genius and woke up the town idiot† Although sales continued to drop in 2003, Herman Miller returned to reparability in that year. To do so, Herman Miller had to drop its long-held tradition of lifelong employment; approximately 38 percent of the workforce was laid off, and an entire plant in Georgia was closed. Mike Evolved and Brian Walker, then president of Herman Mill er North America, met with all the workers to tell them what was happening and why it had to be done.One Of the workers being laid off was so moved by Evolved and Walkers presentation that she told them she felt sorry for them having to personally lay off workers. To replace the tradition of lifelong employment, Evolved, tit input from many others, developed what the company referred to as â€Å"the new social contract. † He explained it as follows: We are a commercial enterprise, and the customer has to be on center stage, so we have to first figure out whether your gifts and talents have a match with the needs and wants of this commercial enterprise.If they don't, then we want to wish you the best, but we do need to tell you that I don't have a job for you right now. As part of the implementation of the social contract, the company redesigned benefit plans such as educational reimbursement and 401 (k) plans to be more portable. This done to decrease the cost of changing job s for employees whose gifts and talents no longer matched customer needs. Herman Miller's sales and profits began to climb from 2003 to 2008. In 2008, even though sales were not at an all-time high, the company's profits had reached a record level.Walker became president in 2003 and CEO in 2004. Evolved became chairman of the board in 2004. Then Herman Miller was hit by the recession of 2009. Sales dropped by 1 9 percent, from approximately $2. 0 billion in 2008 to approximately $ 1. 6 billion in 2009. In the same years, profits dropped from $1 52 million to $68 million. In March 2009, Mark Churchman, director of external communications at Herman Miller, predicted that the changes made to recover from the 2001-2003 recession would help the company weather the recession that began in late 2007.HERMAN MILLER IN 2012 Herman Miller had codified its long-practiced organizational values and published them on its website on a page titled â€Å"What We Believe. † Those beliefs, liste d as follows, were intended as a basis for uniting all employees, building relationships, and contributing to communities: ; Curiosity & Exploration: These are two of our greatest strengths. Management Mike Evolved remained chairman of the board in 2012, and Brian Walker was president and CEO. Walker's compensation was listed by Bloomberg Businesslike as $693,969 in 2011. The magazine listed compensation for Coos at four competitors as ranging from $778,000 to $973,000.Walker and our other top executives at Herman Miller took a 10 percent pay cut in January 2009 and, along with all salaried workers, another 10 percent cut in March 2009. The production workers were placed on a work schedule that consisted of nine days in two weeks, effectively cutting their pay by 10 percent as well. That the executives would take a pay cut before salaried workers, and one twice as much as that required by workers, was just one way human compassion was practiced at Herman Miller. However, most employees' pay cuts and furlou ghs were ended in June 201 0 when the company's financial performance began to improve.By U. S. Securities and Exchange Commission (SEC) regulations, a publicly traded Company had to have a board of directors. By Herman Miller's corporate policy, the majority of the 14 members of the board had to be independent. To be judged independent, the individual as a minimum had to meet the NASDAQ National Market requirements for independent directors (NASDAQ Stock Market Rule 4200). In addition, the individual could not have any â€Å"other material relationship with the company or its affiliates or with any executive officer of the company or his or her affiliates. Moreover, according o company documents, any â€Å"transaction between the Company and any executive officer or director of the Company (including that persons spouse, children, stepchildren, parents, stepparents, siblings, parents-law, children- in-law, siblings-in-law and persons sharing the same residence) must be disclosed to the Board of Directors and is subject to the approval of the Board of Directors Or the Nominating and Governance Committee unless the proposed transaction is part of a general program available to all directors or employees equally under an existing policy or is a purchase of Company reduces consistent with the price and terms of other transactions of similar size with other purchasers. † Furthermore, â€Å"It is the policy of the Board that all directors, consistent with their responsibilities to the stockholders of the company as a whole, hold an equity interest in the company. Toward this end, the.Board requires that each director will have an equity interest after one year on the Board, and within five years the Board encourages the 5 directors to have shares of common stock of the company with a value of at least three times the amount of the annual retainer paid to each director. † In there words, board members were held to standards consistent with Herman Mill er's corporate beliefs and its ESP. program. Although Herman Miller had departments, the most frequently referenced work unit was the team. Paul Murray, director of environmental health and safety, explained the relationship between the team and the department as follows: At Herman Miller, team has just been the term that has been used since the Scansion Plan and the De Peres brought that into Herman Miller. And so I think that's why we use that almost exclusively.The department-? as a department, we help facilitate the other teams. And so they aren't just department driven. Teams were often cross-functional. Membership on a team was based on the employee's ability to contribute to that team. As Gave Wing lead chemical engineer for the company's Design for the Environment division, described it, You grab the appropriate representative who can best help your team achieve its goal. It doesn't seem to be driven based on title. It's based on who has the ability to help us drive our init iatives towards our goal. Teams were often based on product development. When the product had been developed, the members of that team were redistributed to new rejects.New projects could come from any level in the organization: One way in which leadership was shared at Herman Miller was through the concept of â€Å"talking up and down the ladder. † Workers at all levels were encouraged to put forth new ideas. Herman Miller environmental specialist Rudy Barrels said, If they try something they have folks there that will help them and be there for them.. That requires a presence of one of us or an e-mail or just to say, â€Å"Yeah, I think that's a great idea. † That's how a tot †¦ In the organization works. Because Herman Miller workers felt empowered, a new manager could run onto some startling behavior. Paul Murray recalled, can remember my first day on the job. I took my safety glasses 0 if . ND an employee stepped forward and said, â€Å"Get your safety glass es back on At [Company X, Company there was no way they would have ever talked to a supervisor like that, much less their supervisor's manager. It's been a fun journey when the workforce is that empowered. The company's beliefs were also reinforced through the Employee Gifts Committee and the Environmental Quality Action Team. True to Herman Millers practice of shared leadership, the Employee Gifts Committee distributed funds and other sources based on employee involvement. Jay Link, manager of corporate giving explained the program as follows: Our first priority is to honor organizations where our employees are involved.We believe that it's important that we engender kind of a giving spirit in our employees, so if we know they're involved in organizations, which is going to be where we have a manufacturing presence, then our giving kind of comes alongside organizations that the/re involved with. So that's our first priority. In addition, all Herman Miller employees could work 16 pa id hours a year with a charitable organization of their choice. The company set goals for the number of employee volunteer hours contributed annually to its communities. Progress toward meeting those goals was reported to the CEO. The Environmental Affairs Team, formed in 1 988 with the authorization of Max De pre, had responsibility for such activities as recycling solid waste and designing products from sustainable resources.One of the team's successes was in the reduction of solid waste taken to landfills. In 1 991, Herman Miller was sending 41 million pounds of solid waste to landfills. That figure was down to 24 million pounds by 1 994 and to 3. 6 million pounds by 2008. Such improvements were both environmentally friendly and costiveness. Herman Miller's beliefs carried over to the family and the community. Gave Wing related, â€Å"I've got the worst lawn in my neighborhood. That's because don't spread pesticides on it, and don't put fertilizer down. † He went on to say that he and his wife had to make a difficult decision in the summer of 2009 6 because Herman Miller had a policy â€Å"to avoid PVC [polyvinyl chloride] wherever possible. In restoring their home, they chose fiber cement board over PVC siding even though the fiber cement board was considerably more costly. Wing said, â€Å"Seven years ago, I didn't really think about it. † Rudy Barrels was involved in a youth soccer association that raised money to buy uniforms by collecting newspapers and aluminum cans. Barrels said, â€Å"When I'll speak they'll say, ‘Yeah, that's Rudy. He's Herman Miller. You should-?you know we're goanna have to do this. â€Å"‘ The company's beliefs carried over to all functional areas of the business. Some of them were obviously beneficial, and some were simply the way Herman Miller chose to conduct its business.

Blaxicans and Other Reinvented Americans Essay

In â€Å"Blaxicans† and Other Reinvented Americans,† Richard Rodriguez points out that America has become a place that is fully populated by immigrants from around the world. He asserts that there is no way to assign race names to citizens because everyone can be multiple races. According to Rodriguez, Americans create labels (e. g. Hispanic) in a ridiculous attempt to classify people in the simplest form; a plan doomed to fail. Rodriguez continues by describing his idea of â€Å"ethnicity,† which is ultimately based on the way people act and the things they value. The article describes the way in which all races are intertwined within the country, and within the world. The idea of â€Å"diversity† is also mentioned in the article when discussing the topic of interracial marriages. Rodriguez goes on to describe the false â€Å"Hispanic† category much of this country has fallen into. Ultimately, Rodriguez explains that â€Å"Hispanic† is a term used only in America for colonization purposes. Hispanic is a false idea because upon going to Latin America, one would encounter black Hispanics, white Hispanics, etc.and that is factual. By 2003, Hispanics became the largest minority in the world (whatever that means). Rodriguez goes on to share his views on assimilation: â€Å"ASSIMILATION HAPPENS. † Assimilation is the act of people of different backgrounds viewing themselves as a part of a larger national family. This article acknowledges the vast array of racial possibilities within the world. Rodriguez ends the article by saying he, a man of Mexican descent, is Chinese because he enjoys Chinese culture, and that is how ethnicity should be decided. There are many rules, legislations and services like care standard act, care quality commission, commission for social care inspection, race relation act, age relation act, gender discrimination act which aims to ensure the best quality care for the people with all age groups. From the scenario, we have seen that Mr. Frazer is suffering from Alzheimer disease and he needs both long term and short term care as he is passing his days with lots of difficulty. Hamm (2007) has stated that, people with Alzheimer disease need more likely long term cares. The UK legislations have set up lots of policies and standards so that organizations can give the best the possible care to their clients. Among them, the care standard act 2000 describes that, all the care homes or residential homes must fulfill some specific requirements which are necessary to take care of their patients or clients. For example, it describes a category of people who are not suitable to work with vulnerable adults. In addition, it reforms a regulatory system for the care service organizations such as care homes, childrens homes, nursing homes, domiciliary agencies, voluntary adoption agencies, fostering agencies. While providing service to a patient like Mr. Frazer, they have to maintain the legislations. So, a service provider will must check whether they have employees with sufficient knowledge on Alzheimer disease before involving him/her to give him care. Some of the factors are given below: Problems in communication: Communication problem creates severe problems while providing care as sometimes they can not understand both written and spoken language because of the damage of corresponding nerve. In addition, patients may speak native language where care giver does not speak the same. In this case, misunderstanding may occur that leads to negative outcome for both groups. Sometimes they may not understand proper language, sign language, body language or meaning of normal picture. In these cases, doctors or care workers may fail to realize their needs and may not the best care. Aggression: Aggressiveness is common often among the Alzheimer patients. So, they may feel irritated if they are asked to describe about their present health condition. In the same time, care givers or doctors will not know patients needs if he/she does not tell them. If they are requested to explain more than once, they become aggressive other than helping them by giving answer. Culture, attitude and beliefs: Health care providers may fail to realize the cultural needs of patients. People from different culture have different cultural norms, beliefs, attitude and expectation. Question 2 2.1 Factors that may have contributed to loss of independence, non-participation and social exclusion for Ellen According to Arber Evandrou (1993), there are many factors which can contribute to loss of independence, non-participation and social exclusion and these can be being dependent to someone including care workers, not given time to make choice for them, constraint, changing something related to them without taking their permission, not giving chance to participate in decision-making. Dependency: Most of the cases, vulnerable adults like Mrs. Ellen loss their independency and social exclusion because of being dependant to someone such as care workers. Sometimes the patients may not be permitted to carry their day to day activities because of lack of ability or risk. Service users physical and mental conditions may be considered strictly. They may not be given permission to choose how they will spend their times, how they spend their money, where will they spend their leisure time, what will be their regular diet etc. because of lack of skills. As a result, they will loss their minimum capacity to lead a life of their own. So, they may be reluctant to participate in social events as it may be insulting for them that they are dependant. Keeping away from decision making: From the scenario, we have seen that Mrs. Ellen was given chance to make her own decision. But, usually service users in the care homes or nursing homes may not be given this opportunity because they may cause a problem. This can cause frustration and they become more dependant. Constraint: this is one of the major ways for what service users become dependants. It can cause threat as they may be forced to think as other people think. Mrs. Ellen was not forced to do anything while staying in the care home. She was encouraged to perform her all day to day activity and as a result she become a role model in that care home. Basically, adults should be assisted to carry their day to day activity but not doing the total thing for themselves. They may think about their inability but they should be encouraged to work by themselves assessing the risks. Otherwise, they will be dependant, frustrated and will lose their taste of life. 2.2 Processes and support mechanisms to maximize independence and choice for individuals like Ellen Sussex Scourfield (2004) describe that empowerment of social, physical, emotional needs, intellectual factors, access to information, maintaining confidentiality, participation in decision-making and choice can maximize the independence and choice for individuals. These are given below: Promoting rights of them. For example, letting them to maintain their confidentiality, safety and security Allowing them to take risks. But risk must be assessed. If that can cause severe problem, they might be encouraged restrain from certain things. Allowing them to communicate and make relationships with anyone that they want. Allowing them to individualised care, involving responsibilities etc. Everyone has responsibility not to infringe on the rights of other people. Individuals must be given chance to take their own decision and make choices for them. Individuals will get full access to gather information. They must be given right to carry out their religion and cultural activities. Providing a range of options from which they can make choices Encouraging them to solve problems in the future on their own successfully. 2.3 Organisational systems to promote participation and independence for individuals According to Sussex Scourfield (2004), empowering individuals potentiality, ensuring performance of workers, proper guidelines and inspirations to work by own initiatives, staff training, getting feedback, inspection and opinion sources of information for each and every individuals can be a few examples to promote participation and independence for individuals by organizational systems. These are described below: Empowering individuals: Heumann et al (2001) state that, each and every employee of any organization may be promoted to participation and independence by empowering their sleeping potentiality. According to him, the development of service delivery and service quality may be increased significantly by the empowerment of employees. To implement this, proper guidelines to let them work by themselves will be necessary. Thereafter, they can be told the benefits so that they can realize the necessity of the empowerment. (Anderson Aydin, eds., 2005) 2.4 Tensions that arise when balancing the rights of the individual to independence and choice against the care providers duty to protect According to Thompson et al (2006), there are many factors which cause dilemma while providing care to the vulnerable adults e.g. Safety vs. independence, safety vs. rights and responsibilities of individuals etc. For example, if patients with dementia or frail people want to go somewhere by themselves, then care providers are in trouble. People with dementia may loss their way and find it difficult to retrieve it. In addition, they can cause harm to others and themselves by their aggressive behavior. Frail people may fall down easily and cause serious harm to them. So, the relatives or even the person himself/herself may complain against the care providers when they are in trouble. Considering these factors, care providers are reluctant to let them do anything which can harm their clients. In the same time, each and every individual has right to live independently but it can cause conflict between relative vs. client, client vs. employee, employee vs. relative, children vs. parent, parent of children vs. service providers and staff vs. staff. Thus, tensions can arise while balancing the rights and choice against the care providers duty. Overall, care providers will first consider and ensure their clients safety and then independence. Question 3 3.1 Identifying and explaining risk of abuse or harm from the case study through the case study. From the given scenario, we have seen that Mr. Simon was abusing eight elderly clients in his care which affected his clients very badly. His clients might have to face (opuronio) loss for that abuse. Now the risk of abuse and the way they could be harmed are given below: It has been said in the scenario that one of the lady who is aged 78 years old was poured cold water and stocking over her head. Researchers have shown that cold water during shower helps to get good health for the normal aged people where it harms elderly people. According to Thygerson (2007), it can increase the risk of heart attack. Putting stocking over the head can choke the lady and lead to death. It can cause paralysis as well. Mr. Simon also harassed sexually one of the elderly ladies who are 92. It is really matter of shame and strong sexual abuse against that lady. That lady must feel very ashamed that can lead her to suicide. Also, she can be injured seriously physically as body structure becomes very sensitive at those ages. Obviously it is illegal and humanistic to force anyone to do anything though sometimes that can be good for the person. Anyone can be requested to do anything but is up to the person to accept any help or service or whatever. A 96 year elderly client was forced to eat her food though she was reluctant. Also, Mr. Simon poured sherry into one of his clients throat who was 81. that could cause her choke. As a result, she might die. It could also cause her vomit which can lead to loss of appetite. She was being physically abused during her care. Without this, as many of his clients were suffering from senile dementia and psychological problem, they might not remember what happened to them during their care and might think whatever has been done as a part of their treatment! This is a clear indication of physical and mental abuse. Physical abuse was acute for the clients who were wheelchair bound because they could not either protect him or take themselves in safe position quickly. In addition, their privacy, self esteem, dignity, choice, respect, safety have been neglected instead of giving them appropriate care. 3.2 Options to protect individual from abuse whilst balancing legislation requirements and guidance with the tensions involved According to Pritchard ed. (2008), there are some legislations and guidance to protect and safeguard of the vulnerable adults in the UK. Among them human rights act 1998, Disability discrimination act 2003, Protection of Vulnerable Adult (POVA), Care standard act 2008 are the most effective acts to ensure the safety of vulnerable adults and protect them from any kinds of harm. The scenario has shown that some of the clients were being abused mentally and physically during their care though they were staying in a nursing home. Basically, abuse can happen because of lack of proper implementation of national legislations. According to the legislations, vulnerable adults may be suggested to stay in their own home or care homes or nursing homes or hospitals in accordance with their health condition. But risks must be assessed before taking any decision. In addition, clients have the right to choose any types of service they need for. They can also refuse all the services as well if they w ant unless they are mentally handicapped. Thus individuals can be protected from abuse at the same time as balancing legislation requirements and guidance. 3.3 The effectiveness of policies, procedures and managerial approach for promoting management of risks for a known setting According to Torrisi Hansen-Turton (2005) and Kemshall Pritchard (1997), every organization should have some organizational policies, procedures and managerial approach of their own to run their business effectively and to gain their goals easily along with national policy, procedures and laws. For example, a nursing home should have some legislations regarding acceptable and unacceptable risk, protection from unacceptable risk, assessing and recording risk, participation in creating abuse-free environment, complaints procedures, leadership style, whistle blowing policy along with national service standards. Among them assessing risk, leadership style and complain procedures are significant to promote management risks. A nursing home must have adequate equipment to deal with patients. In addition, early identification of possible abuse, screening of people who are going to start work, reporting to people with proper procedure, getting feedback and opinion from clients, keeping as e ye and proper monitoring system of the clients finance, psychological and physical issues can also promote management of risk. 3.4 Justify recommendations for improving management approaches to managing risks of abuse in the setting of the case study Parsloe (1999) and Messer Jones (1999) have shown that, the management can play an important role to manage the risks of abuse. Some important recommendations are given below to manage risk: A care worker may be monitored or supervised by an authorized person while providing care. Screening of people will help to obtain an employees mentality about his/her job role. Getting regular feedback from client will disclose the quality of service that they are getting. So, staff will try to give their best to achieve reputation which will minimize risk. Having necessary equipments cut the danger of life respectively. For example, a service user may need to be transferred for emergency. In this case, having ambulance facility is a plus point to cut risk and abuse of treatment. Stealing, creating psychological or physiological harms are the cases that happen in care homes, nursing homes or in hospitals. So, monitoring of employees will help to manage risk of abuse as well. Question 4 4.1 The legislation, guidance, codes of practice and policy that apply to the handling of medication According to Association for Real ChangeÂÂ  (ARC) et al (2006), there are some particular laws, legislations, guidance and policies to handle medication as well as its ordering and maintaining, administration, storage, recording, and disposal. These are Drug act 2005, PoisonsÂÂ  and Therapeutic Goods Act 1966 No 31, PoisonsÂÂ  and Therapeutic Goods Regulation 2008, Public Health (General) Regulation 2002, Medicines act 1968, Drug misuse act 1986 etc. These laws and legislations have described the management and supervision systems for the administration, storage, disposal and recording of medication. According to a new law, a registered nurse (grade 1, minimum) must handle the administration of medication to ensure the standard of care in the care homes. In addition, it provides safeguards for the administration of medication along with personal care attendants and in the hostels. Medicines act 1968 has provided a legal framework within which doctors, surgeons, pharmacists, suppliers and nurses are able to administer medications. According to this act, there are some medicines which are restricted to sale, supply and administration. A drug handler must have to have license to prescribe or dispose any medicine. They also have to renew every licence granted under this Act, unless previously renewed or revoked or will expire at the end of the period of five years from the date on which it was granted or the date as from which it was last renewed. Drug act 2005 and misuse of drug act 1986 have provided very strong law to handle and protect the misuse of drugs. According to this act, a supplier of drug has to prove that, it has a valid intention to provide drugs. Court can assume against a supplier for abusing drug if they can find out less amount of drug than prescribed. In addition, an issue can be raised if the accused may not have had the drug in possession with the intent. Thus these legislations, guidance and policies help to safe handling of medicine. 4.2 National service standards to promote safe practice in the handling of medication According to Crouch et al (2008), todays medicines are powerful compounds to control disease, ease discomfort and prolong life for millions of people and are generally beneficial. But nothing in the world gives us only blessings. Almost all the medicines have got side effect to human body. This is why, national standards, legislation, national enquiries e.g. the Shipman Enquiry, ethical issues, service user choice, acceptable risk etc. have been introduced to minimize the risks and promote safe practice of medication. Another author named Railton (2007) has stated that, all the clinicians, doctors, nurses, care workers, pharmacists have to meet national minimum standard while handling the medicine. For example, a practitioner must have to have a valid license for practicing or prescribing medicine. According to McGee ed. (2009), some of the key principles to promote safe practice are given below: Clients of social care services have freedom to choose concerning their provider of pharmaceutical care and services including dispensed medicines. Care staffs have to be aware of medicines that each client has and a complete account of medicines will be recorded by the social care service. Care staffs help people with their medicines have to be well-trained and competent. Medicines must be given correctly and safely, and care staffs have to preserve the privacy and dignity of the individual while giving them medicine. Medicines should be available when the patient/client needs them and the service provider will make sure safe disposal of unwanted drugs. Medication orders must be timed; dated, signed and handwritten orders must be readable. Only approved hospital abbreviations will be used. Medicines must be stored safely. The social care service will have an access to advice from the pharmacists. Medicines have to be used to cure, prevent disease and to relieve symptoms. Medicines can not be used to punish or control behavior. 4.3 Evaluating the effectiveness of policies and procedures for administering medication to achieve best possible outcomes for service users Thomas et al (2003) has shown that the policies and procedures help to achieve the best possible outcome for administrative medication and care homes are one of the examples of it. He shows that, care homes reduce the risks of medication by following the policies and procedures. As a part of medication administration policy, now they keep all the records of medication to avoid future risk. Sometimes they check or review the side effects of any drugs in the internet and discuss with any third party if necessary. According to Thomas et al (2003) and Boon et al (2006), effectiveness of policies and procedures are given below: Each and every written order for medication must state the names of medication clearly which have been ordered. Justification for Eddie as a Loveable Character in A View From The Brid

When Alfieri makes his final speech, he says that he 'will love him' (Eddie) more than his 'sensible clients', referring to the usual longshoremen and their relations mentioned at the beginning of the play. However, it is unlikely that Alfieri means 'love' as in 'loveable', due to the fact that Alfieri says before that this love is because of the fact that Eddie 'allowed himself to be fully known'. This could be referring to the fact that everyone around Eddie can see his love for Catherine e.g. at the end, Beatrice tells Eddie that he 'wants something else' other than Marco's apology (i.e. Catherine), and Alfieri mentions that ?she can?t marry you, can she Eddie is also described by Alfieri as ?not purely good?, emphasizing the fact that Alfieri does not see Eddie as loveable. The ?love? referred to could be that Alfieri respects Eddie for allowing the people around him to know his feelings. However, Eddie can?t see the true nature of his own love for his niece, and he cannot admit that his relationship with her goes far beyond father/daughter love. Eddie may not be loveable in the normal sense of the word, but at the beginning of the play, we can still see him as a likeable man ? an ?average?, flawed person. He cares for Catherine as a daughter, and tells her near the end that he ?only wanted the best? for her (Only Eddie is ?the best?, and nothing else will do?). However, he also acts like a young lover near the beginning of the play when we see Eddie and Catherine together for the first time, the stage directions say that Eddie is ?pleased, and therefore shy about it? when Catherine greets him. He is also overprotective of her, a combined result of the ?wrong kind of love? and the fatherly love he has for her, just before M... ...nitched to the immigration? they spit on him in the street? Active Euthenasia – From A Kantian Perspective Euthanasia is one of society's more widely debated moral issues of our time. Active euthanasia is; "Doing something, such as administering a lethal drug, or using other ways that will cause a person's death." In the other hand, Passive euthanasia is; "Stopping (or not starting) a treatment, that will make a person die, the condition of the person will cause his or her death." It seems that this one is not to debate, as much as the other one (active). I have chosen to look more closely at the issue of active euthanasia, and that it should not be considered ethical, by Kantian standards. Those who support active euthanasia can argue that helping the ill to bring their own deaths, allowing them to determine the how and when, is not only a human act but also allows the person, who is "living to die," to maintain their dignity; this way, they will let them die in peace, rather than suffer to the end. Because if not, they think of themselves as a disgrace, to those they love. According to recent researches and surveys, many Canadians would agree to this, but my question is, have they taken a close look at the ethical debate? Those who are against active euthanasia would say not, and would argue that by participating in the practice of active euthanasia, they are "playing God," or perhaps, that they are not acting out of mercy, therefore, the act is nothing less than cold-blooded murder. Murder by the law is defined as; "The unlawful, premeditated killing of one human being by another." Euthanasia, in Canada, remains unlawful as of today, and the act of euthanasia is premeditated, whether for the purpose of mercy or not, euthanasia is, by definition, murder. According to Kantian perspective established by Kant the philosopher, and the Holy Bible, murder is both a sin and a crime, therefore we ought not participate in the practice of euthanasia, because it is murder, and it is the wrong thing to do. The euthanasia debate raises many questions. Questions such as: who is the one benefited by the murder? Or should we allow family members to make a life-or-death decision over a loved one who may never have expressed a desire to die, simply because they could not say with words a will to live? President AJ Andrew Jackson was born in 1767, and grew up in the border of North and South Carolina. He attended frontier schools and acquired the reputation of being fiery-tempered and willing to fight all comers. He also learned to read, and he was often called on by the community to read aloud the news from the Philadelphia papers. In 1775, with the beginning of the American Revolution, Andrew Jackson, then only 13 years old became an orderly and messenger. He took part in the Battle of Hanging Rock against the British and in a few small skirmishes with British sympathizers known as Loyalists or Tories. His brother Hugh was killed, and when the British raided Waxhaw, both he and Robert were captured. Because Jackson refused to polish the boots of a British officer, he was struck across the arm and face with a saber. The boys were put in a British prison in Camden, South Carolina, where an epidemic of smallpox broke out. Mrs. Jackson gained her boys' release, but Robert soon died. Mrs. Jackson then volunteered to nurse other American prisoners, and she too caught smallpox and died. Andrew was now 14 years old and without any immediate family. With the war over, he took up saddle making and school teaching. With a $300 inheritance from his grandfather, he went to Charleston, South Carolina, then the biggest city in the South. There he cut a dashing figure in society until his money ran out. In 1787, Andrew Jackson became a lawyer and he set his office up in McLeanville, North Carolina. He quickly became successful lawyer and engaged himself in land speculation. He soon moved his office to Nashville where he met and fell in love with Mrs. Rachel Donelson Robard. Believing that Mr. Robards had obtained a divorce, they were married in 1791. Two years later they found that this was not so and the divorce had just then become final. A second marriage ceremony was performed. However, this failed to prevent gossips and political opponents from attempting to make a scandal out of the Jacksons' happy marriage. Mrs. Jackson endured in silence the many slanders that followed. Jackson, however, preferred to use dueling pistols to avenge his wife's honor. In 1796, Andrew Jackson was elected into the House of Representatives, representing Tennessee. He soon allied with the Jeffersonian Party, criticizing Washington and his administration. He claimed th... ...ssly by the letter of the Constitution, unauthorized by its spirit, inconsistent with every principle on which it was founded, and destructive of the great object to which it was formed. Jackson also pushed through Congress a force bill that authorized the use of federal troops to collect the tariff. The crisis was eased when, through the efforts of Henry Clay, Congress passed a compromise tariff in 1833 along with the force bill. As a last defiant gesture, South Carolina accepted the tariff but nullified the force bill. Jackson had preserved the Union, but nullification remained a great question. By 1836 Jackson was weak from tuberculosis and had no thought of seeking a third term. However, he stubbornly continued with affairs of state and party, including ensuring that the party nominated Van Buren as his successor. Although he was eager to return to the Hermitage after Van Buren's election, he grimly fulfilled the duties of his office until the inauguration the following March. The last day of Jackson's presidency was as much a personal triumph as his first. Thousands came, not to see the new president but to bid good-bye to their beloved hero. Bibliography: Encarta
